Booking Terms and Conditions.
Your acceptance and use of this Booking Application and Agreement means that you fully understand, agree to and accept the following Terms and Conditions. Please download and keep a copy for your records.
This Agreement constitutes a limited short term license granted by Blackmore Court as licensor, to the resident as licensee, for the use of the property known as Blackmore Court as a personal residence during their stay. The parties understand and agree that it is not their intention to create a landlord-tenant relationship; that their intention is strictly contractual in nature, providing the resident with short term accommodations subject to the specific requirements and limitations set out herein.
This license allows you use the space assigned. Only licensees may use these areas in accordance with Blackmore Courts rules and regulations governing such areas.
Liability Blackmore Court cannot be responsibility for loss or damage to valuables or personal property. nor shall be liable nor will accept responsibility for any injury, loss or damage howsoever sustained by any person or persons whether arising under the express or implied term of the licence agreement, or at common law ( including any negligence of the proprietors, their servants or agents ) or in any way whatsoever. The exclusion of the implied terms contained in Section 39 of the Sale of Goods and Supply of Services Act 1980 subject to the provision of Section 40 of the said Act.
General Provisions Blackmore Court reserves the right at any time to: (a) alter, change, or cancel a housing assignment; (b) designate any or all housing as available for expanded occupancy. (c) change any room assignment or rate; (d) enter apartments or rooms during reasonable hours at the request of one of its licensees or for routine maintenance, inspections, repairs, and housekeeping duties after notifying a licensee orally ,by text, email or in writing of the date of entry; (e) enter residences at any time for an emergency; (f) control the residences in the event of an emergency; (g) terminate the Housing Agreement for violation of these Terms and Conditions, for health, safety, anti-social, threatening behaviour or for other reasons deemed sufficient by the management at Blackmore Court.
Further Regulations The Booking Agreement is subject to all relevant policies of Blackmore Court which may be amended or updated from time to time as necessary, including all regulations developed by the Housing Division, Health Safety and Fire Departments.
License Period: The license period is only for the period shown on the Booking Application.
Booking 0n receipt of your on-line enquiry for accommodation you will receive a Letter of Offer confirming the type of room available. This room offer will be valid for a period of 5 days during which time you will need to send a Cheque or Bank Draft made payable to Blackmore Developments and posted to Blackmore Court Accommodation, Blackmore Lane, Meade Street, Sullivan’s Quay, Cork. for the sum of 450 Euro. This 450 Euro will then be held as a Security Deposit for any loss or damage to the property, or any bills, fees or charges left outstanding at the end of term at which time the property will be inspected after all personal items have been removed and prior your to departure.
Releases and refunds The Booking Application Form once accepted is binding for the entire length of your booking. Incompatibility with your flatmate or your involvement in another lease will not be accepted as a reason. No refund will be given to residents evicted for Drug use, unacceptable, anti social or threatening behaviour.
Conduct Residents staying in Blackmore Court are subject to its financial rules and regulations. Tenants are expected to cooperate in creating a pleasant living and study environment for each other. You are personally responsible for abiding by the security policies pertaining to the residential facilities.
Inspections. Should any apartment fall below an acceptable standard of cleanliness, contract cleaners will be instructed to provide a once off cleaning service. The relevant occupants will be charged for same. The Landlord retains the right to visit any room or apartment to carry out maintenance work and inspections if and when necessary and to conduct viewings in the apartments for any room that may be vacant.
Damages We consider the accommodation provided by Blackmore Court to be your home during your stay, and we expect you to exercise reasonable care to preserve the condition of your home. You will be responsible for any damage or defacement that may occur to your assigned residence, except for normal wear and tear. The Fault Report Forms you submit will serve as a source of reference. We will bill the charges to the occupants for damages to rooms, if we cannot determine responsibility for damage or defacement in common areas (bathrooms, lounges or corridors, etc.), we will distribute the charge equally to all residents of the facility.
Fire Alarm Activation The unnecessary activation of the Fire Alarm is considered a serious act of vandalism and will not be tolerated. All Fire Alarm activations will be subjected to a 400 Euro fee. This is to cover the cost of call out charges from two companies in order to close the Smoke Vents situated on the 2nd floor, 3rd floor and on the roof and to recalibrate the Elevator and the Fire Alarm System. A report will be issued by the Fire Alarm Company identifying which sensor in which room caused the activation. Should activation come from a sensor in any of the common areas the CCTV cameras will highlight who caused the activation. If your Fire Alarm activates for any reason other than a Fire, this is classed as a pre alarm and you have 1 or 2 minutes to open your doors and windows to ventilate your room, this will stop your Fire Alarm going into full alarm mode and opening all Smoke Vents and shutting down the Elevator. If the Alarm is activated call the mobile number on the Fire Alarm panel situated in the entrance hall. This may save you the 400 Euro call out charges. Residents are responsible for any charges incurred in the event of the Fire Services attending the premises.
Keys are the property of Blackmore Court and are computer coded to stop duplicate keys being made without authorised permission. You will be charged for each lost key and for each replaced lock core. If you lose or fail to return a bedroom, hall, or apartment key, you will be billed for replacing all affected keys and locks. You must report lost keys promptly to the office to arrange replacement. Return your keys immediately on departure to avoid being billed for core and key replacement. Accommodations Office will provide instructions for proper check-out. Keys are non-transferable. Only the license who has accepted the Booking Agreement for a particular room may pick up room keys for that room. Any license who gives his keys to another person not resident in the building will be served with a Notice to Quit. Any license who leaves a guest unaccompanied in the building for whatever reason or length of time will be served with a Notice to Quit.
Guests Visitation is negotiated with respect for rights and responsibilities of flatmates. You must have your flatmate’s consent to invite a guest into your apartment, and then you are restricted to 1 guest. The presence of the guest must not pose an unreasonable burden or unreasonable infringement on the privacy and privileges of the other flatmates. It is strictly forbidden for a Guest to stay overnight any breach of this rule will result in a Notice to Quit being served. Guests are only permitted in the building between the hours of 11am and 11pm. License are responsible for the behaviour of their guest and conformance with all of the Policies of Blackmore Court.
Security You are personally responsible for abiding by the security policies pertaining to residential facilities. Their is a 400 Euro fee charged for the setting off of the Fire Alarm as this shuts down the elevator and opens the smoke vents on the roof, 2nd floor and 3rd floor and necessitates two separate companies to be called out to re calibrate same. Your guests are your responsibility, do not let them embarrass you.
Insurance License are advised to secure personal property insurance to protect against personal loss or damages. Each apartment door should be locked when not in use. The majority of licensees can obtain coverage under their home owner’s policy, but all residents should consult an insurance agent to determine if this is so, or whether a renter’s policy is necessary. Blackmore Court is not liable to reimburse residents for damage to personal belongings regardless of the cause of damages.
Smoking and Pets are not permitted in Blackmore Court.
Noise is expected to be kept at a level that will not cause disturbance to your flatmates or to neighbouring apartments. Noise should not be audible from outside your apartment. Parties are strictly forbidden in the apartments. Should you experience disturbance at any time, please call the management on the contact number provided 24 hours a day to report same in confidence.
CCTV All public stairs, halls and landings are covered with CCTV for your security. Any license found to have damaged or interfered with anything on the premises will be reported to the Gardai. It is the policy of Blackmore Court to file a Criminal Damage Report in all cases.
Furnishings and Contents Blackmore Court will choose and provide furnishings and contents for each apartment. All the furniture must remain in its assigned space. If you provide any furniture or contents you have an obligation to take them with you on departure, failure to do so will involve you in the cost of their removal. Photos, posters or wall hangings are not permitted to be attached to the walls by any method or means, failure to comply with this will involve you in the expense of making good the wall finish.
Services Blackmore Court provides heat, power, light, WiFi internet, Sky to Air, refuse collection and water. The times for turning on the storage heaters is based on the overall heating plan and is not subject to individual wishes. Individual bedroom radiators have thermostatic valves and may be used when needed. It is not permitted to cover or dry items on these electric heaters due to the danger of causing a fire. The temperature of the water in the storage tank is regulated regionally by the system. We also arrange for refuse pick-up and grounds maintenance services. You must dispose of refuse in proper containers and take it out of the apartment each evening. Please recycle as much as possible and use the appropriate refuse bins in the back yard.
Maintenance and Repairs Blackmore Court shall perform all interior and exterior maintenance and repairs as necessary. You should report all breaks, damages and need for repairs to the Accommodations Office by using the Fault Report Form on the website. Do not make your own repairs. Residents are required to check their smoke detectors weekly. When you check in, you must complete an on-line Fault Report Form to document the physical condition of the room and furnishings in order to prevent receiving inappropriate bills for damage on departure. The condition in which the apartment is returned will have a strong bearing on the amount of the security deposit refunded.
Prohibited Possessions To ensure the safety of the residents, the following are specifically prohibited in student rooms and apartments, pets, exterior aerials or satellite dishes, cooking and heating appliances, space heaters, firearms (including B.B. guns, bows and arrows, paintball guns, ammunition, firecrackers or explosives), weapons (including slingshots, swords, knives, martial arts tools, etc.), open flames (including candles, incense, oil lamps, etc), halogen lamps, lava lamps, plastic lamp shades, extension cords (multiple-outlet connections are permissible only with a built-in circuit breaker and U.L. approved), Christmas trees, Christmas lighting and any other item which Blackmore Court deem to be dangerous or illegal.
Prohibited Activities. All State, and local laws, as well as policies and regulations of Blackmore Court, have full force and effect. This Agreement prohibits violations of those laws and regulations. Remember that the Housing areas are not private property. Many of the prohibitions are required for your safety by the Health, Safety and Fire Regulations. The following activities are not permitted in residence areas: (a) Water bombs or water fights; (b) Snowball throwing; (c) Removal of furnishings from rooms, apartments or lounges; (d) Removal of window blinds; (e) Erecting exterior clotheslines. The use of clothes horses for the purpose of drying or airing clothing, towels ect. Using any heaters provided for the purpose of drying or airing items. (f) Posting leaflets, etc. on locations other than designated bulletin boards; (g) athletic games or activities within the building; (h) Illegal parking of motor vehicles and parking in service areas in and around the residential area; (i) Riding bicycles in residence halls, stairs, etc.; parking of bicycles in access and entrance ways. This includes storage in stairwells, lounges, corridors, bathrooms, or any other areas in the building except in the rear patio. (k) Use of an exit way for any purpose that will interfere with its service as an exit; (l) Altering or tampering with heating, electrical, fire safety, internet or security systems including but not limited to smoke detectors, fire alarms, and door lock systems; (m) Collecting or assembling flammable materials or materials that constitute a fire hazard. This includes the use of candles or other open flames. (n) Any activity that contradicts the Housing Division Fire Code & Decorations Policy.
Recreational Drugs The use, supply or storage of any recreational drug within the building is not permitted under any circumstances. Any resident found to be using, buying, selling, storing or in possession of drugs will automatically be removed from the premises. This does not affect your Statutory Rights. It is the policy of Blackmore Court to file a complaint with the Gardai in any matter relating to drugs.
Criminal Conviction or Protective Order If you are convicted of any crime requiring your registration on the Sex Offender or Crimes Against Minors Registry or if you become subject to a protective order at any time during the term of your stay, you are required within 10 calendar days of the conviction or entry of the protective order, to notify Blackmore Court in writing , The Housing Division reserves the right to cancel any booking if, in the sole judgment of Blackmore Court a tenant may pose a threat of substantial harm to others or to the property or if Blackmore Court determines that the booking was accepted on the bases of inaccurate or incomplete information in the application.
Contact information It is the responsibility of all residents to keep the accommodations office up to date of any changes made to their mobile phone number or email address. Please note that only mobile phone numbers that have been registered with the accommodation office can be answered outside of office hours. In case of emergency do not text. The system can only handle and redirect phone calls, from phone numbers that you have previously registered.
After hours call out In the event of an emergency call out of staff outside of 7am to 5pm office hours Monday to Friday there will be a charge of 75 Euro applied.
Change of Rate or Occupancy During the summer, the Housing Division will review all room assignments for withdrawals or changes and may reassign licensees as needed to make efficient use of available space, you may be reassigned to vacancies in other rooms or have roommates assigned to your room at any time.
Assignment and Subletting You may not assign this Agreement or sublet the premises or any part thereof. The facility is to be used only as a residence. You may not use your room for business or financial gain. We assign flatmates based on information provided to us on the Booking Application and try to assign like with like.
Sales, Solicitation, and Peddling Sales, solicitation, and peddling are forbidden in Blackmore Court. This includes deliveries of goods or operating a private business. You may arrange to meet a delivery yourself, but vendors are not allowed to enter the residence halls.
Holiday Decorations (and other special events): In response to Fire Code Regulations, published instructions relative to decorating with electrical and flammable products are available from the office.
General Provisions Blackmore Court retains unilateral right to terminate this license for the breach of any Term or Condition of this Agreement by the license. Failure of either party to insist upon strict performance of any of the Terms or Conditions herein shall not be deemed a waiver of any rights or remedies of either party, and shall not be deemed a waiver of any subsequent breach or default in any of the Terms or Conditions herein. Blackmore Court does not discriminate in any of its, procedures, or practices on the basis of age, citizenship, colour, handicap, national origin, political affiliation, race, religion, sex, or sexual orientation.
